There's Bug 78783 but I didn't understand if it's related.

repro 7.2+ I noticed that Format -> Bullets and Numbering works "as expected". So some code from there could be borrowed. (But care should be taken to NOT be misleading if the current paragraph is not actually using Chapter numbering, but just normal numbering. In that case, I agree with Cor that it should default to Level 1.)
